After an FIR against Snapdeal for selling prescription drugs online, a case has now been filed against mobile wallet service provider Paytm directors (Vijay Shekhar sharma and Harinder Pal) for fraud transactions amounting to Rs 22 lakh under sections of Forgery and IT Act.
According to a report in The Times of India, Madhya Pradesh Police have booked the directors of Paytm in a case of alleged forgery where in fraudsters used Paytm as the gateway for monetary transactions.
The fraudsters used to call people posing as bank managers and offered easy loans. They would acquire details of ATM cards and used Paytm to recharge mobile phones and DTH. "During conversations, the accused claimed that there is a problem with the ATM card of the customers and asked for the ATM and pin numbers on the pretext of changing the ATM card and pin number.
As soon as the ATM card and pin numbers are given, the customer gets an alert on his mobile about the amount debited from his account. After getting ATM number the gang used mobile wallets such as Paytm as gateway to transfer money from the customer to their SIM card and used it for recharge, DTH and online shopping," Thetradeboss report said, quoting police officers.While Paytm will be aware of the accounts to which these fraud transactions were made, it is simply not possible for them to know that the transactions were carried out using stolen card details.
As a Media Nama report points out, "even in case one or more merchants on Paytms platform were involved in this fraud, the platform itself isnt liable as per Indian law, if it didnt knowingly abet the fraud.
In India, Section 79 of the IT Act proffers safe harbor to intermediaries (marketplaces, aggregators and platforms), as long as they act on complaints and do not knowingly allow the usage of their platform to break the law.Cases have also been registered against directors of Xenon Value Services India Private Limited, Vtech ventures, designing hub and apkacareer.com.
